- WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, BE TIMELY, SECURE, UNINTERRUPTED, ERROR-FREE, ACCURATE, COMPLETE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
- WE DO NOT WARRANT OR GUARANTEE ANY PARTICULAR RESULTS, OUTCOMES, EARNINGS, PERFORMANCE, UPTIME, AVAILABILITY, COMPATIBILITY, OR CONTINUED ACCESS.
- ANY INFORMATION, CONTENT, OR MATERIALS PROVIDED THROUGH THE SERVICES ARE FOR GENERAL INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS PROFESSIONAL, LEGAL, FINANCIAL, MEDICAL, OR OTHER SPECIALIZED ADVICE UNLESS EXPRESSLY STATED IN WRITING.
21. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, RYAN SPEGAL, DOING BUSINESS AS SPEGAL.DEV, AND ANY AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, SUPPLIERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
- Your access to, use of, inability to use, or reliance on the Services;
- Any unauthorized access to, use of, or alteration of your content, account, or data;
- Any bugs, interruptions, downtime, service failures, outages, delays, or errors;
- Any third-party conduct, content, products, platforms, APIs, or services;
- Any decision we make regarding account suspension, termination, content removal, billing enforcement, or access restrictions; or

- TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE APPLICABLE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100.00).
- SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE PROVISIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.
22. Indemnification
- You agree to defend, indemnify, and hold harmless Ryan Spegal, doing business as Spegal.Dev, and any affiliates, contractors, service providers, licensors, suppliers, and partners from and against any claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use of or misuse of the Services;
- Your User Content;
- Your violation of these Terms;
- Your violation of any law, regulation, contract, or third-party right;
- Your fraud, negligence, willful misconduct, or unauthorized activity; or
- Any dispute between you and another user or third party connected to your use of the Services.
